NovisKit User Agreement
Effective Date: June 17, 2026
This NovisKit User Agreement (hereinafter referred to as "this Agreement") is entered into voluntarily by you (hereinafter referred to as the "User") and the service operator (hereinafter referred to as "we", "us" or "our"). This Agreement defines mutual rights, obligations and legal relations between users and us during your use of NovisKit image processing toolkit (hereinafter referred to as "this Application"), guarantees stable operation of in-app image editing services, and protects legitimate legal interests of both parties.
Please read and fully understand all clauses of this Agreement before downloading, accessing or using this Application. Your use of all services provided by this Application confirms that you have read, understood and accepted all terms herein, and agree to be legally bound by this Agreement. If you disagree with any clause of this Agreement, you shall stop using this Application and all related services immediately.
I. Scope of Services and Usage Prerequisites
1.1 Service Content
We provide professional local image processing toolkit services for users, including but not limited to the following editing functions:
- Image Watermarking: Add custom text, pattern and transparent watermarks to pictures
- Image Format Conversion: Convert pictures to mainstream formats including PNG, JPG, WEBP, BMP
- Image Cropping: Free size cropping, ratio cropping and border trimming for photos
- Image Clarity Adjustment: Optimize sharpness, definition, brightness and texture of original images
- Auxiliary Services: Personal account management, edited image local/cloud storage, official customer support and technical maintenance services
1.2 Usage Prerequisites
Users shall meet all the following conditions to use this Application normally:
1. Be at least 13 years old. Users under 13 years old may use this Application only after reading this Agreement accompanied by legal guardians and obtaining explicit guardian consent;
2. Equip qualified mobile terminal devices (smartphone, tablet and other devices) and stable network environment, and the device system version meets the minimum operating standards of NovisKit;
3. Abide by this User Agreement, NovisKit Privacy Policy, and applicable local laws, regulations and industry supervision rules.
II. User Rights and Obligations
2.1 User Rights
1. Legally use standard image editing services provided by this Application, and independently enable or disable optional editing functions within the scope of this Agreement;
2. Submit function failure feedback, system bugs and service abnormal problems to us via the official contact mailbox specified in Article X. We will respond and handle valid user applications within a reasonable period, generally no more than 15 working days;
3. Query, revise and clear personal account information, or apply for account cancellation in accordance with NovisKit Privacy Policy. After account cancellation, all bound user data will be deleted per privacy rules and cannot be retrieved;
4. Export edited image works freely, and permanently delete original uploaded image files stored on platform servers.
2.2 User Obligations
1. Shall not use this Application to conduct illegal, immoral or rule-breaking behaviors, including but not limited to: editing pornographic, violent, illegal and sensitive images, processing pictures involving minors’ privacy, spreading harmful image files, launching network attacks, stealing third-party information, disseminating computer viruses and malicious programs;
2. Shall not edit, modify or disseminate images that infringe third-party legitimate rights, including unauthorized editing of copyrighted pictures, unauthorized modification of others’ portrait images, production of deceptive forged pictures;
3. Shall not reverse-engineer, modify, rewrite App code, interface and protection mechanism, bypass platform security verification, or install modified, cracked, unofficial versions of NovisKit;
4. Take full responsibility for keeping account password, terminal device and in-app image data safe. All information leakage, image loss and account risks caused by device loss, password disclosure and unauthorized login shall be borne solely by the user;
5. Shall not interfere with other users’ normal use of image editing services, and shall not damage intellectual property rights, privacy rights and other legitimate rights and interests of us and any third party;
6. Before editing any portrait image materials, users must obtain complete and valid use consent from the relevant portrait owner independently.
III. Our Rights and Obligations
3.1 Our Rights
1. We have the right to optimize App interface, editing logic and functional modules based on technical iteration, regulatory requirements and user experience demands, including improving processing speed, repairing system vulnerabilities and updating editing tools. We will issue advance notice via in-app pop-up windows and update notes before formal adjustment;
2. If users violate clauses in Article 2.2, endanger platform operational security or infringe third-party legitimate rights, we have the right to take disposal measures including partial function suspension, account permission restriction and device access ban. We will cooperate with official regulatory investigation when necessary;
3. We have independent discretion to accept or reject user customized editing function suggestions based on technical feasibility, operational cost and platform development planning;
4. Deploy intelligent content audit system to identify and block illegal, sensitive and prohibited image editing behaviors.
3.2 Our Obligations
1. Maintain daily stable operation of core image editing functions, and conduct regular platform security maintenance. We will not be liable for service interruption caused by force majeure, operator network failure, user device failure and other uncontrollable external factors;
2. Collect, store and process user image data and personal information strictly in accordance with NovisKit Privacy Policy. We will not disclose, transfer or sell user personal information without legal basis or user explicit authorization;
3. Automatically erase all facial feature data and biometric information within 72 hours after image editing processing is completed, complying with platform privacy provisions;
4. Timely follow up user legitimate appeals including system failure feedback and privacy consultation, give clear handling results and safeguard user legal rights;
5. Publicize complete data retention rules and user personal data rights clearly inside the Application.
IV. Service Changes and Termination
4.1 Service Changes
1. We may adjust and optimize in-app editing services according to business operation arrangement, including adding new image editing tools and shutting down low-frequency unused functions. Updated service rules will be announced inside the App. Your continuous use of the App means acceptance of adjusted services;
2. If service suspension is required due to updated laws or official regulatory requirements, we will inform users in advance via in-app announcements and official emails, and specify suspension reasons and estimated recovery time for restorable services.
4.2 Service Termination
We have the right to terminate all or partial service access of users without bearing breach liability under the following circumstances:
1. Users violate this Agreement and refuse to rectify violations after platform reminder, or user behaviors seriously violate national laws and regulations;
2. Users actively apply for account cancellation, or user devices cannot adapt to App operation due to hardware failure and system upgrade without feasible solving solutions;
3. Normal service operation cannot be maintained due to force majeure, policy change, major technical breakdown and other uncontrollable factors. We will try our best to resume services and notify users after troubleshooting.
V. Edited Image Content Statement
5.1 Content Ownership
1. Original User Images: Users retain full ownership of all original pictures uploaded to this Application;
2. Edited Images: Users own full ownership of all images processed and edited via NovisKit tools. Subject to your compliance with this Agreement, you may use edited images for personal and legal commercial purposes. We do not claim ownership of user edited image content.
5.2 User Content Warranties
Users hereby confirm and guarantee that:
1. Users own complete legal use rights for all uploaded original image materials;
2. Users have obtained explicit portrait use consent from all individuals appearing in uploaded portrait images;
3. Uploaded images do not contain minors, vulnerable groups, violent, pornographic or illegal sensitive elements;
4. Uploaded and edited image content will not infringe third-party copyright, portrait right, privacy and other legitimate rights;
5. User use and dissemination of edited images will not violate any third-party legitimate rights.
5.3 Content Usage Limitations
1. Edited image effect may vary slightly due to original image resolution, device parameters and network status;
2. We do not guarantee edited images can fully meet all user customized aesthetic and usage demands;
3. All uploaded and edited images are subject to platform unified content audit supervision.
5.4 Third-Party Services Note
This Application may integrate official third-party payment channels and auxiliary technical interfaces. We shall not be liable for the operational stability, data security and legality of independent third-party services. Disputes arising from third-party services shall be settled between users and third-party service providers independently. We will never transmit user image data and personal information to any third-party AI or editing service providers.
VI. Intellectual Property Rights
6.1 Platform Intellectual Property Rights
All intellectual property rights of this Application, including App program code, editing tool design, interface layout, trademark, logo, built-in editing algorithm and official copywriting, belong exclusively to us. Users shall not copy, spread, modify, disassemble or transfer platform intellectual property assets, and shall not use App core editing functions and code for commercial secondary development, repackaging and resale behaviors.
6.2 User Edited Content Intellectual Property
Users own full intellectual property rights of all images edited and exported by themselves. Users grant us limited non-commercial authorization to store edited images only for providing image editing services. If user uploaded or edited images cause third-party infringement claims, users shall bear all legal liabilities independently, and we will not bear joint liability.
VII. Disclaimer
Within the scope permitted by applicable laws, we shall not be liable for losses or liabilities caused by the following circumstances:
1. Service failure, image loss and file missing caused by user device fault, network disconnection and user manual misoperation;
2. Service interruption and data leakage caused by force majeure, policy adjustment, network attack and hacker invasion;
3. Device damage and information disclosure caused by users using unofficial App versions or modifying App programs via external tools;
4. Economic loss and reputation damage caused by users relying on third-party service content or false public information;
5. Function restriction imposed legally on users violating platform rules;
6. All right infringement disputes caused by user editing and dissemination of unauthorized image content;
7. Disputes caused by users failing to obtain valid portrait authorization before editing portrait images.
OUR IMAGE EDITING SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT GUARANTEE THAT ALL EDITED IMAGES WILL MEET USER EXPECTED EFFECTS.
VIII. Agreement Updates
We may revise this Agreement irregularly to adapt to legal update and service upgrade. The latest revised Agreement will be published on the “Settings - User Agreement” page inside the App with updated effective date. If revised clauses change users’ core rights and obligations, we will notify users via in-app pop-up windows and official emails. Your continued use of the App after revision equals acceptance of updated terms. If you disagree with revised clauses, please stop using the App services.
IX. Dispute Resolution
9.1 Applicable Law
The formation, performance, interpretation and dispute resolution of this Agreement shall be governed by applicable local laws and regulations, excluding conflict of laws rules.
9.2 Dispute Handling
In case of any dispute arising from the performance of this Agreement, both parties shall resolve it through friendly negotiation firstly. If negotiation fails, either party has the right to file a lawsuit with the competent court at our registered location.
